There is so much to be said about so many aspects of this whole horrible mess, primarily, I think, regarding the morality as opposed to the legality.
But the overriding thing I keep coming back to every time I hear someone endeavoring to impose some fine legal distinction between one technique and another is this:
OF COURSE IT'S TORTURE. OTHERWISE WHY THE HELL WOULD THEY BE DOING IT?
You don't waterboard someone to provide him with a simulated day at the beach. You do it to torture information out of him or to inflict extra-judicial punishment whether for alleged crimes or some infraction of your precious rules.
Once you understand that, all the rest is complete crap.
