Another Habeas Win

Today Judge Kessler granted the Habeas Petition by ALI AHMED. The hearing was two weeks ago and the unclassified opinion should be available by the end of the week.

ORDER: For the reasons stated in this Court's Classified Memorandum Opinion, Petitioner Alla Ali Bin Ali Ahmed's Petition for a Writ of Habeas Corpus is hereby GRANTED; the Government shall take all necessary and appropriate diplomatic steps to facilitate Petitioner's release forthwith and shall report back to the Court no later than June 15, 2009, as to the status of Petitioner's release. I'm not mistaken, this continues the trend of detainee wins of habeas cases before judges who are not named "Richard Leon"... such detainees are winning at a rate of something like... "100%;" even counting Judge Leon, detainees have still won over 90% of cases that have had merits considerations.

Apparently, it wasn't just the last Administration that wanted to "make its own reality". If judge after judge concludes that there is no "there there" for the legality of these detentions, one would think the Obama Administration would wake up to it too.

Of course, that might involve the executive deferring to the rule of law... would it not?
